CONTRACT / GUARANTEE
The Seller, Ball Ground Alapahas, and the Buyer, ______________________, hereby agree as follows:
The Seller hereby sells to the Buyer, for the amount of $____________, payment of which is hereby acknowledged, a male/female
Alapaha Blue Blood Bulldog of _____________(Breed/Show or Pet) quality, born ________________, by Ball Ground Alapahas (“BGA”)
out of _______________________________________________________________________, in accordance with the terms of this
contract.
1. The Seller will register the puppy/dog with the Alapaha Blue Blood Bulldog Association (“ABBA”) and provide puppy/dog registration papers to the Buyer. The Seller cannot guarantee how long it will actually take to get registration papers. The Buyer shall not register the puppy/dog or permit the puppy/dog to be registered with any other registry other than ABBA.
2. Purchaser agrees to place the “BGA” prefix before any other name on the registration papers. Any references to the animal in publication should reference the BGA prefix. 
3. The Seller warrants that the above described puppy/dog is in good health at the time Buyer assumes ownership. The Buyer shall maintain the puppy/dog in good condition, including adherence to a regular immunization schedule, heartworm preventative, good diet, regular exercise and a clean and safe environment. The Buyer will, at no time, engage the puppy/dog in dog fighting.
4. Buyer agrees to have the puppy/dog examined by a licensed Veterinarian within two (3) days (not including weekends and holidays) of receipt of puppy/dog. If, as a result of the examination, the Veterinarian determines that the puppy/dog is not in good health, then the Buyer shall elect to keep the puppy/dog or return the puppy/dog to the Seller for a refund. If the Buyer elects to return the puppy/dog, Buyer shall, within 10 days after the date of the signing of this contract, send to Seller by certified mail a written Veterinarian's certificate stating that the puppy/dog was in ill health when examined. Upon receipt by Seller of said certificate, Buyer shall be obligated to return the puppy/dog to Seller’s at Buyer’s expense. Upon receipt of the puppy/dog, the Seller shall be obligated to refund all monies received from Buyer toward the purchase price of the puppy/dog, and further performance under this contract shall be null and void. All action taken to return the puppy/dog shall be done with the best interest of the puppy/dog in mind, including temperature at time of shipment and availability of non-stop flights. The Seller will instruct and reserve the right to a second veterinarian opinion at the expense of the Seller. If the puppy/dog is not examined by a veterinarian within three days after delivery time, the above guarantees are no longer in effect.
5. If said puppy/dog develops a crippling hip dysplasia within 24 months from date of birth, the Buyer may return the dog to Seller and will receive a replacement puppy/dog of like quality from the next available litter, or may keep the dog and Seller will refund the full purchase price. The dysplasia results must be verified by veterinary and Orthopedic Foundation for Animals (OFA) reports, and if the Buyer returns the dog, the ABBA registration must accompany the dog. If there is any evidence of trauma or injury this contract is void.
6. Seller can ship the puppy/dog at the Buyer’s expense. The price of the puppy/dog does not include the shipping cost and will be an extra expense to the Buyer. The price for shipping usually varies from approximately $350 within the continental United States.
7. Deposits are refundable before the designated pup is born. Deposits are non-refundable after the pup is born. All deposits may be transferred to a pup from a future litter from any breeding at BGA.
8. If BGA has determined that the puppy/dog is of "pet quality" and is NOT suitable for breeding, the Buyer agrees not to breed the puppy/dog. If the puppy/dog is sold as pet quality, the Buyer understands that registration papers will not be provided to the Buyer unless evidence from a licensed veterinarian is provided to the Seller that the puppy/dog has been neutered/spayed.
9. The Buyer shall not sell the puppy/dog, or its offspring (if any), to any individual or establishment in the business of buying and selling puppies for a profit including, but not limited to a pet store, pet farm or puppy mill. If the Buyer is found guilty of violations of the Animal Welfare or Animal Abuse laws, ownership of the dog will transfer back to Seller without refund of purchase price to the Buyer and all transportation costs will be at the expense of the Buyer.
10. The puppy/dog is warranted only for the purpose of being a companion animal and while it may be capable of performing other functions, no warranty is given as to its fitness for any special purpose.
11. Seller shall not be held responsible for the development of faults, diseases, or disorders, which are due to Buyer’s negligence.
12. Should Buyer choose to break any of the portions of this agreement, the remainder of the agreement will be considered null and void.
13. Although there are no plans at present to stop breeding Alapahas Blue-Blood Bulldogs, the above guarantees are valid only so long as Breeder is breeding said dogs. Should Breeder cease breeding said dogs, for any reason, this Sales Contract will become null and void. In the event of a dispute, the state of Georgia will have jurisdiction over the matter.
14. This contract is valid only for the original Buyer and dog, it is non-transferable.
